Previous research has shown that personal contacts are powerful intermediaries in transmitting job lead information for both job seekers and employers and therefore could contribute to various forms of gender inequality by, for example, providing higher-quality job leads to men than to women. The authors use a unique data set that includes information on the quality and source of individual job leads to explore whether the overall quality of job lead information depends solely on various attributes of recipients' contacts or (...) whether job lead quality is also conditional on gender. These data are based on a diverse sample of professional, technical, and managerial workers from California. Findings indicate that the overall quality of the respondent's job leads is a product of their gender and that of the person providing the lead. In addition, net of a variety of factors, women and men with young children at home receive significantly lower-quality job leads. (shrink)

Research on mental health of non-professional caregivers has focused on caregivers of people with specific diseases, especially dementia. Less is known about caregivers of people with other diseases. The aims of this study were (a) to determine the caregivers’ emotional state in a random sample of caregivers of people in situations of dependency, (b) to analyze the association between each disease of the care-recipient (a variety of 23 diseases included in the International Classification of Diseases) and the emotional state of (...) the caregiver, and (c) based on the theoretical model, to analyze the relationship of the different study variables in the appearance of the emotional distress of the caregiver. A sample of 491 non-professional caregivers was selected randomly (89.0% women, average age 55.3 years). Trained psychologists collected sociodemographic and care-related characteristics and evaluated the global emotional distress, somatic symptoms, anxiety-insomnia, social dysfunction, depression, probable mental disorder case, self-esteem and social support. It was found that (a) the caregivers showed moderate emotional distress, and 33.8% presented a probable mental disorder. (b) Caring for a care-recipient with cat's cry syndrome or epilepsy was related to suffering from social dysfunction, and caring for a care-recipient with autism was related to having a probable mental health case. (c) Social support mediated the relationship between social class, daily hours of care, monthly family income, self-esteem and global emotional distress. There is an important impact on the emotional state of the caregivers. This impact was similar in caregivers of care-recipients with different diseases, except in caregivers caring for a care-recipient with cat's cry syndrome or epilepsy (related to social dysfunction), and in caregivers caring for a care-recipient with autism (related to having a probable mental health case). Law seems to be irremediadibly connected to the experience of coercion and to a structure of hierarchy. This is so because it has traditionally been defined as a set of authoritative prescriptions, usually commands backed by the menace of a sanction, an evil eventually applied through the use of overwhelming violence. Law has also been related to some kind of structure or system which is intrinsically hierarchical, both in the sense of the hierarchy of people whose conduct is addressed by (...) the law and in the sense of the logical interdependence of the legal prescriptions themselves. The British legal philosopher H. L. A. Hart criticizes in his celabrated book The Concept of Law powerfully the command theory and also reshapes the theory of the hierarchical structure of rules. The paper will tries to follow Hart’s attack to the traditional imperativistic view and will then focus on his treatment of international law. The aim is to show on the one side how promising Hart’s approach could be, and on the other side how poor however his conceptualization of international law at the end of the day reveals to be. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. L’activité créatrice du design industriel est l’héritière directe du concept grec du τέχνη, et de la notion romaine d’ ars. Au contraire des Beaux-Arts, le design n’a jamais complètement renoncé à sa dimension fonctionnelle, et sa créativité s’est déployée au service des objets qui nous entourent. Victor Papaneck a lancé en 1971, dans son libre Design for the Real World, un appel à l’attention des designers en leur rappelant leur responsabilité sociale et en exigeant d’eux une attitude respectueuse envers l’environnement. Pour cela il est nécessaire d’analyser, à partir des produits concrets des designers au xxi e siècle, la nouvelle orientation de l’ecodesign et d’approfondir les lignes d’action du design actuel qui maintiennent un engagement éthique avec la société : inclusive design/universal design et design pour la nécessité/ Design Takes of Risk. Law is traditionally related to the practice of command and hierarchy. It seems that a legal rule should immediately establish a relation between a superior and an inferior. This hierarchical and authoritharian view might however be challenged once the phenomenology of the rule is considered from the internal point of view, that is, from the stance of those that can be said to “use” rather than to “suffer” the rules themselves. A practice oriented approach could in this way open up (...) a more liberal, and also somehow less parochial and ideological, road for legal theory. This is – it is argued in the paper – the programme, or better, the promise we can find in Herbert Hart’s main work, The Concept of Law. The article tries to render this promise more transparent while, nonetheless, not eschewing the blind sides of its narrative and argumentative strategy. (shrink)

During the course of its short history the discipline concerned with the origin of life has given birth to several scientific programmes in the Lakatosian sense, two of the most prominent and widespread being those initiated by Oparin (life began from protein entities) and Muller-Haldane (life began from genetic entities). The present paper sets down the bases for the rational reconstruction of both views by identifying their hard core and some of their successive developments. An assessment is made of the (...) various stages in the evolution of these programmes with respect to the crucial Lakatosian notions of progressivity and regressivity and of how their arguments stand up against one another. This epistemological analysis also establishes the internal reasons why the RNA version of the genotype programme (developed in particular by L. Orgel and S. Spiegelman) has today taken on a progressive character and enjoys recognition by the international scientific community. (shrink)

The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. This paper presents an analysis of the new teaching methodologies in times of confinement due to the pandemic caused by Covid-19. RATIONALE, AIMS AND OBJECTIVES: This paper deals with the problem of surgical waiting lists and is aimed, in particular, at comparing two different prioritization approaches: (1) the clinical assessment of treatment urgency aimed at categorizing patients into urgency-related groups (URGs) with a given recommended maximum waiting time for treatment; and (2) the implementation of an original prioritization scoring algorithm aimed at determining the relative priority of each patient in the waiting list and the corresponding order of admission. METHODS: A modelling (...) exercise based on a cohort of 236 patients enrolled on the waiting list of a surgical department in an Italian public university hospital, from 1 January to 30 June 2004, is presented. The comparison is based on a measure called need-adjusted-waiting-days, which allows to take into proper account both urgency and priority. RESULTS: The results show that both methods should be implemented simultaneously for increasing the department's performance in terms of both efficiency--outcome gained from a given amount of resources--and equity--how patients are admitted according to their need. CONCLUSIONS: Waiting list prioritization should not be limited to classifying patients into URGs, but to using a scoring system as well, in order to schedule patient admissions in an explicit and transparent way. La réflexion sur l’éthique et la participation des jeunes et des enfants à l’aménagement com- porte au moins deux dimensions : d’une part, les justifications d’une telle participation ; d’autre part, les problèmes que la pratique participative fait émerger et face auxquels les cadres de réfé- rence conventionnels (non participatifs) ne sont pas toujours utiles. Le présent article aborde ces deux dimensions et explore leurs liens à la lumière de trois méthodes distinctes en matière de théorie morale, soit l’éthique déontologique, (...) l’éthique conséquentialiste et l’éthique de la vertu. Sur la base d’une expérience participative d’aménagement inscrite dans le programme Grandir en Ville de l’UNESCO, certaines contradictions entre les principes d’une pratique participative avec des enfants et la manière dont les problèmes éthiques sont parfois gérés sont mises en évidence. Nous présentons la notion d’« être au monde » de Merleau-Ponty, en prenant comme point de départ l’étude de l’auteur sur le rapport mère-enfant dans la première étape de l’enfance (de 0 à 3 mois). Dans cet article nous nous appuyons, spécifiquement, sur le cours tenu à la Sorbonne entre 1949 et 1952, influencé par les travaux de la psychologie de la Gestalt et de la psychanalyse, pour montrer comment, à partir de la relation et de l’unité mère-bébé, on peut (...) expliciter ce que Merleau-Ponty pense de l’intersubjectivité et l’idée qu’il se fait du corps comme projet orienté vers le monde. Nous voulons montrer comment Merleau-Ponty rapproche la philosophie de la réalité concrète et comment il analyse le développement de l’enfant en tant que processus d’individualisation.We explore Merleau-Ponty’s notion of “being-toward-the-world,” taking his study on the mother-child relation during the first stage of infancy (0-3 months) as our point of departure. In this article we consider, more specifically, the Sorbonne lectures of 1949-1952, which were influenced by works in Gestalt psychology and psychoanalysis, in order to show how, starting from the relation of the mother-baby unity, we can clarify what Merleau-Ponty thinks of intersubjectivity, and his idea of the body as project oriented toward the world. We wish to show how Merleau-Ponty brings philosophy closer to concrete reality and how he analyzes child development as a process of individualization. Presentiamo la nozione di “essere al mondo” in Merleau-Ponty prendendo come punto di partenza i suoi studi sul rapporto madre-bambino nella prima fase dell’infanzia (dagli 0 ai 3 mesi di età). In quest’articolo consideriamo, in particolar modo, il corso tenuto alla Sorbona tra il 1949 e il 1952, influenzato dai lavori di psicologia della Gestalt e dalla psicoanalisi, per mostrare come, a partire dalla relazione dell’unità madre-bambino, possiamo esplicitare ciò che Merleau-Ponty pensa dell’intersoggettività e l’idea che si è fatto del corpo come progetto orientato al mondo. Vogliamo quindi mostrare come Merleau-Ponty avvicini la filosofia alla realtà concreta e come analizzi lo sviluppo del bambino in quanto processo d’individualizzazione. (shrink)

The first goal of this paper is to reply to a number of criticisms levied by Gunnar Breivik and Robert L. Simon against an account of sporting skills I published almost 20 years ago in which I distinguished between constitutive and restorative skills and examined their normative significance. To accomplish this goal, I first summarize my characterization and classification of skills and then detail the criticisms. After responding to the latter, and thus reconsidering and hopefully strengthening my account of skill (...) in sport, I turn my attention to Scott Kretchmar and Tim Elcombe’s inquiry into the skills involved in competitive sport. These authors claim that contesting skills demand the same respect usually accorded to testing skills. The second goal of this paper is then to explore Kretchmar and Elcombe’s inquiry under the light of my reconsidered analysis of skill. I specifically advocate a plausible relationship, both in terms of their distinctive character and relative import, between testing and contesting skills and constitutive and restorative skills. In doing so, I seek to present a more comprehensive account of skill in non-competitive and competitive sport. (shrink)

Comment et pourquoi la philosophie juridique et politique contemporaine est-elle revenue à Kant? Il faut pour le comprendre s'intéresser d'abord à l'ancrage de la pensée du droit dans la théorie kantienne de la raison pratique et aux problèmes que pose le statut kantien d'une raison normative dans les deux champs coordonnés de l'éthique et du droit. L'articulation entre droit privé et droit public, entre droit et politique dans la Métaphysique des moeurs doit être considérée en relation avec l'exigence d'une fondation (...) unitaire du système des normes pratiques. La philosophie politique de Kant peut dès lors être envisagée dans le prolongement de sa théorie du droit international, avec l'ouverture d'une perspective cosmopolitique qu'il importe de définir avec précision. Studies on the conservation of the inferred transcriptional regulatory network of prokaryotes have suggested that specific transcription factors are less‐widely conserved in comparison to their target genes. This observation implied that, at large evolutionary distances, the turnover of specific transcription factors through loss and non‐orthologous displacement might be a major factor in the adaptive radiation of prokaryotes. However, the recent work of Hershberg and Margalit1 suggests that, at shorter phylogenetic scales, the evolutionary dynamics of the bacterial transcriptional regulatory network might (...) exhibit distinct patterns. The authors find previously unnoticed relationships between the regulatory mode (activation or repression), the number of regulatory interactions and their conservation patterns in γ‐proteobacteria.
